Fujimoto Chemicals Co., Ltd. requires all its suppliers and business partners, including those supplying raw materials for its pharmaceutical products and other products procured through trading company activities, to comply with national and local laws, rules, and regulations while respecting internationally recognized codes of conduct and adhering to each of the following standards in this Code of Conduct. In addition, suppliers shall also encourage their next-tier suppliers to comply with this Code of Conduct and accordingly obtain necessary information for compliance. If this Code of Conduct is not in line with national and local laws and regulations, the stricter standards should be applied.
The free will of all workers shall be respected. Workers shall not perform forced or compulsory labor, including bonded (including debt bondage) or indentured labor as well as involuntary or exploitative prison labor. Terms and conditions of employment shall be provided in advance in a language that the worker understands. All work must be voluntary, and workers shall have the freedom to leave work or terminate their employment at any time. The identity documents or immigration documents of workers such as government-issued identifications, passports, or work permits shall not be retained, destroyed, concealed, or confiscated unless required by law. Workers shall not be required to pay any employment placement fees or other fees related to their recruitment. If the worker is found to have paid such fees, the fees shall be refunded to the worker.
Children under the minimum working age of 15 (or under the age for completing compulsory education or the national minimum age for employment, whichever is higher) shall not be employed at any stage of manufacturing. In addition, workers under 18 years old (young workers) shall not engage in night shifts, overtime work, or other work that threatens their health and safety.
The weekly working hours must not exceed the maximum set by the local law. A workweek shall not exceed 60 hours per week, including overtime, except in case of emergencies or other crises. Workers shall be entitled to at least one day off per week.
Remuneration that complies with all applicable wage laws, including those related to minimum wage, overtime, and legally mandated benefits, must be paid to the worker without delay upon presentation of pay slips. No unjustifiable wage deductions shall be made.
The human rights of workers shall be respected and there shall be no unpleasant or inhumane treatment, including sexual harassment, sexual abuse, corporal punishment, mental or physical oppression, or verbal abuse, nor shall there be any threat of such treatment. Measures shall be taken to prevent and respond to inhumane behavior.
Any employment practice (including hiring, wages, promotions, rewards, access to training, etc.) shall be free from discrimination based on race, color, national origin, age, gender, sexual orientation, gender identity and expression, ethnicity, disability, pregnancy, religion, political views, union membership, marital status, or any other grounds unrelated to work. Reasonable accommodations shall be made to allow workers perform their religious practices.
The rights of workers to freedom of association, union membership or non-membership, collective bargaining, and peaceful assembly shall be respected in accordance with local laws and regulations. Policies shall be observed to provide reasonable assurance that the use of conflict minerals (tantalum, tin, tungsten, and gold) in products does not directly or indirectly finance or benefit armed groups that are perpetrators of serious human rights abuses in the Democratic Republic of the Congo and neighboring countries.
The workplace environment and working conditions must be assessed accordingly in order to ensure the safety of workers. Preventive and mitigating measures shall be taken through appropriate technical and administrative means in response to the potential dangers or hazards (e.g., chemical, electrical and other energy sources, fire, vehicle, and fall hazards). Workers shall be provided with appropriate and proper health and safety information and training as well as any necessary protective equipment with respect to the risks associated with these hazards. Appropriate measures and proper considerations shall also be taken to minimize occupational health and safety risks for expectant and nursing mothers, which include assignment of duties and provision of reasonable accommodations.
Risks associated with potential emergencies, disasters and accidents shall be identified and assessed. Corresponding response measures shall be prepared and necessary drills shall be conducted. In addition, facility safety inspections shall be conducted, evacuation routes shall be secured, and disaster prevention equipment must be installed and maintained. Emergency measures and response procedures must be implemented to minimize the impact of emergencies. The measures and procedures shall focus on minimizing damage to life, environment, and property.
Measures shall be taken to encourage reports from workers, classify and record occupational injury and illness cases, investigate cases and implement preventive actions. Workers shall be provided with medical examinations in accordance with local regulations.
Physically demanding work which may involve tasks that require manual handling of materials, heavy or repetitive lifting, prolonged standing, heavy assembly work, as well as tasks that may pose health risks, including mental health, shall be identified and managed. Measures shall be taken to prevent occupational injury and illness.
The machine and equipment safety must be assessed and measures such as physical guards, interlocks, and barriers must be taken to prevent workplace accidents.
Facilities provided for workers such as dormitories, cafeterias, and restrooms must be maintained to be clean and safe and provided with appropriate emergency exits, hot water for bathing and showering, adequate lighting and ventilation, separately secured facilities for personal items and valuables storage, and accessible personal space with adequate size.
All required environmental permits, approvals, notifications, and reports shall be completed, kept up-to-date, and observed to adhere to the operational and reporting requirements in accordance with local regulations.
The use of natural resources such as water, fossil fuels, minerals, and virgin forest products shall be kept to a minimum in all business processes, and efforts shall be made to conserve resources and energy through practices such as modifications in production, maintenance, and equipment processes, materials substitution, reuse, conservation, and recycling.
All wastewater shall be monitored, controlled and treated accordingly prior to disposal to prevent the discharge of pollutants into the environment.
Air emissions associated with volatile organic chemicals, aerosols, corrosives, particulates, greenhouse gases, ozone-depleting substances, and by-products of combustion operations shall be characterized, routinely monitored, controlled, and treated prior to discharge to reduce the amount of hazardous substances released into the atmosphere.
(Non-hazardous) solid waste shall be identified, managed, reduced, and properly disposed of as well as recycled.
Chemicals that are harmful to humans or the environment shall be identified, labelled and managed to ensure that they are properly handled, stored, used, recycled, reused, and disposed of. Efforts should also be made to reduce their use, switch to less hazardous substances, and prevent leakages.
Hazardous substances in products and manufacturing shall be identified, and all applicable laws and regulations must be respected.
Policies shall be observed to prohibit all forms of corrupt practices, including bribery, corruption, extortion, and embezzlement.
Bribes or other means of obtaining undue or improper advantage shall not be promised, offered, permitted, or accepted. This includes promising, offering, permitting, or accepting anything of value, either directly or indirectly through a third party to obtain or retain business or to obtain any other improper advantage.
